Fitness Superstore Inc. ("we", "us", “our”) are committed to protecting your privacy.

This Privacy Policy describes our privacy practices on FitnessSuperStore.com ("Website") as to Personal Information of natural persons (“you” or “your”) when we act as the data controller of that Personal Information; in other words, where we determine the purposes and means of the processing of that Personal Information.

Our Terms and Conditions (Agreement) is incorporated into this Privacy Policy whenever applicable. Together, they form a binding agreement between you and us. Any capitalized word used but not defined in this Privacy Policy has meanings as provided in our Agreement.

This Privacy Policy does not apply to any products, services, websites, or content that are offered by third-parties.

1.1   “Personal Information” means any information that identifies or may identify you as an individual.
1.2   We collect your Personal Information in the course of providing the Website to you. Depending on your use of the Website, you might supply us with such information as:

 1.2.7   information regarding identity, including government-issued identification information;
 1.2.8   corporate and financial information; and
 1.2.9   VAT numbers and other tax identifiers.


2. USE OF PERSONAL INFORMATION

2.1 Provide the Website. We use your Personal Information to provide and deliver the Website and process transactions related to the Website, including Account creation, payments, deliveries, refunds, and returns. The legal bases for this processing are contractual necessity and legitimate interest.
2.2 Measure, Support, and Improve the Website. We use your Personal Information to measure use of, analyze performance of, fix errors in, provide support for, improve, and develop the Website. The legal bases for this processing are contractual necessity and legitimate interest.
2.3 Recommendations and Personalization. We use your Personal Information to recommend the Website that might be of interest to you, identify your preferences, and personalize your experience with the Website. The legal basis for this processing is consent and legitimate interest.
2.4 Communicate with You. We use your Personal Information to communicate with you in relation to the Website via different channels (e.g., by phone, email, chat) and to respond to your requests. The legal bases for this processing are consent and legitimate interest.
2.5 Marketing. We use your Personal Information to market and promote the Website. The legal bases for this processing are consent and legitimate interest (where we do not need your consent).
2.6 Fraud and Abuse Prevention and Credit Risks. We use your Personal Information to prevent and detect fraud and abuse in order to protect our security, of our customers, and or others. We may also use scoring methods to assess and manage credit risks. The legal basis for this processing is legitimate interest (detection and prevention of fraud).
2.7 Comply with Legal Obligations. In certain cases, we have a legal obligation to collect, use, or retain your Personal Information. For example, we collect bank account information for identity verification.
2.8 With Your Consent. We may also ask for your consent to use your Personal Information for a specific purpose that we communicate to you. When you consent to our processing your Personal Information for a specified purpose, you may withdraw your consent at any time, and we will stop any further processing of your data for that purpose.
2.9 We never sell your Personal Information. We never share your Personal Information with third-parties for their marketing purposes, unless you consent thereto. The list of third-parties to whom we may disclose to and/or share your Personal Information with is available on request.
2.10 Should we need to process your Personal Information for a new purpose entirely unrelated to the above, we will inform you of such processing in advance and you may exercise your applicable rights in relation to such processing. Please note that without certain Personal Information, we may not be able to provide some or all of the Website or even to guarantee the full functionalities of the Website.


3. SHARING OF PERSONAL INFORMATION

3.1 Our Affiliates. We share Personal Information with our affiliates that we control that are either subject to this Privacy Policy or follow practices at least as protective as those described in this Privacy Policy.
3.2 Third-Party Service Providers. We employ other companies and individuals to perform functions on our behalf. Examples include delivering hardware, sending communications, processing payments, assessing risks, analyzing data, providing marketing and sales assistance (including advertising and event management), conducting customer relationship management, and providing training. These third-party service providers have access to Personal Information needed to perform their functions, but may not use it for other purposes. Further, they must process that information in accordance with this Privacy Policy and as permitted by applicable data protection laws.
3.3 Our and Others’ Protection. We release Account Information and other Personal Information when we believe release is appropriate to comply with the law, enforce or apply our terms and other agreements, or protect the rights, property, or our security, of our customers, or others. This includes exchanging information with other companies and organizations for fraud prevention and detection and credit risk reduction.
3.4 With Your Consent. Other than as set out above, you will receive notice when Personal Information about you might be shared with third-parties, and you will have an opportunity to choose not to share the information.


4. STORING OF PERSONAL INFORMATION

4.1 We are based in the United States (U.S). We provide services globally using computer systems, servers, and databases located in the U.S. When you use our Website from outside of the U.S., your information may be transferred to and processed in the U.S. Please note that U.S. data and privacy laws may not be as comprehensive as those in your country. Residents of certain countries may be subject to additional protections as set forth below.


5. SECURITY OF INFORMATION

5.1 Security is our highest priority. We design our systems with your security and privacy in mind. We adopt appropriate data collection, storage and processing practices and security measures to protect your Personal Information against unauthorized access, alteration, disclosure, or destruction. Unfortunately, no company or service can guarantee complete security. We restrict access to Personal Information collected about you to our employees, contractors, and certain third-party service providers as discussed above. Our security procedures mean that we may request proof of identity before we disclose Personal Information to you.
5.2 Please note, however, that no website or storage mechanism can guarantee 100% security. We cannot guarantee that our security measures will be error-free, that the Website will always be secure, or that unauthorized third-parties will never be able to defeat our security measures or those of our third-party service providers.


6. RETENTION OF PERSONAL INFORMATION

6.1 We keep your Personal Information to enable your continued use of the Website, for as long as it is required in order to fulfill the relevant purposes described in this Privacy Policy, as may be required by law (including for tax and accounting purposes), or as otherwise communicated to you. How long we retain specific Personal Information varies depending on the purpose for its use, and we will delete your Personal Information in accordance with applicable law.
6.2 When you cancel your Account, we take reasonable steps to delete your Personal Information within a reasonable period of time. Sometimes, we may retain your information for a period of time after Account cancellation to allow you to efficiently reinstate your Account if you so choose. We also may retain certain Personal Information after you cancel your Account to the extent necessary to comply with our legal and regulatory obligations, for the purpose of fraud monitoring, detection and prevention, and for our tax, accounting, and financial reporting obligations.


7. DE-IDENTIFICATION OF PERSONAL INFORMATION

7.1 When allowed by applicable law, we will take reasonable steps to de-identify and store your Personal Information after the retention period. We may use de-identified data in some instances. We either maintain such data without attempting to re-identify it or treats such data as Personal Information subject to applicable law.


8. NON-PERSONAL INFORMATION

8.1 Non-Personal Information is information that does not personally identify a person; but may include tracking information about the use of the Website such as devices, location, and demographics. When you use the Website, we collect and store the following Non-Personal Information: analytics data, log files, device identifiers, and location data.

10.1 The Website uses “cookies”, an element of data (usually, a very small file) that a website can send to your browser, which may then store it on your computer or device. These cookies allow us to correctly operate the Website and/or to provide you with pages or content that are tailored to you. This information can, in some cases, be carried from one visit of the Website (or related site) to the next (for example, to help you avoid having to re-enter certain information when you visit the same page later.  10.7.6 The full Uniform Resource Locators (URL) clickstream to, though, and from the Website (including date and time) and the Website, content you viewed or searched for, page response times, download errors, and page interaction information (such as scrolling, clicks, and mouse-overs).


11. USE OF OTHER TECHNOLOGIES

11.1 We also use pixels, web beacons and other similar technologies to recognize your browser or device, learn more about your interests, provide you with essential features and services, and for additional purposes.
11.2 Google Analytics: On our Website, we may also utilize Google Analytics, a web analysis service provided by Google, to better understand your use of the Website. Google Analytics collects information such as how often users visit the Website, what pages they visit and what other sites they used prior to visiting. Google uses the data collected to track and examine the use of the Website, to prepare reports on its activities and share them with other Google services. Google may use the data collected on the Website to contextualize and personalize the ads of its own advertising network. Google’s ability to use and share information collected by Google Analytics about your visits to the Website is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. 12. MANAGING COOKIES AND PRIVACY SETTINGS

12.1 You can manage browser cookies through your browser settings. The 'help' feature on most browsers will tell you how to remove cookies from your device, prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, how to disable cookies, and when cookies will expire. Check the support site for your browser to understand privacy settings available to you. If you block or reject some of our cookies, you might not be able to use some functionalities of the Website.

13. OPTING-OUT OF INTEREST-BASED ADVERTISING ANALYTICS

13.1 We recognize how important your online privacy is to you, so we offer the following options for controlling the interest-based ads you receive and how we use your data. Opting-out of this type of advertising will not prevent you from seeing ads, rather those ads will likely be less relevant. This is because they will not be tailored to your specific interests but will instead be based on the context of the digital property in which they are displayed. Here’s how you can control how we use your data:
13.2 Web Browser: You can opt-out of receiving interest-based ads served by us or on our behalf by Advertising Partner, AdRoll by clicking here. Please note that this “opt-out” function is browser-specific and relies on an “opt-out cookie”. This means if you delete your cookies or upgrade your browser after having opted out, you will need to opt-out again.
13.3 Cross Device Opt-Out: In some cases, we may link multiple browsers or devices to you. If you opt-out on a browser or device and we have additional devices or browsers linked to you, we will extend your opt-out decision to any other linked browsers and devices. Since we only link users across browsers and devices in certain conditions, there may be cases where you are still being tracked in a different browser or device we have not linked, and where we are treating you as a different user.
13.4 Mobile Device Opt-Out: To opt-out of receiving interest-based ads that are based on your behavior across different mobile applications, please follow instructions for iOS and Android devices:
 13.4.1 iOS 7 or Higher: Go to your Settings > Select Privacy > Select Advertising > Enable the “Limit Ad Tracking” setting; and
 13.4.2 For Android devices with OS 2.2 or higher and Google Play Services version 4.0 or higher: Open your Google Settings app > Select Ads > Enable “Opt out of interest-based advertising”.
13.5 Industry Opt-Out Tools and Self-Regulation:
 13.5.1 We adhere to the NAI Code of Conduct. You may use the NAI opt-out tool here, which will allow you to opt-out of seeing interest-based ads from us and from other NAI approved member companies. In addition, the NAI opt-out tool allows you to separately opt-out of “audience matched” advertising through the NAI’s “Audience Matched Advertising Opt-Out” tool. You can also use the email opt-out tool provided by our Advertising Partner, AdRoll, to opt-out your email address from their database. Audience matching is a particular type of interest-based advertising where de-identified data (e.g. hashed emails) is tied to “offline” activity or information (this information generally is or can be associated with a consumer’s email address - whether that information is part of our customer’s own ‘consumer lists’ or in lists we license to the customer.) To do ‘audience matching’, we or another platform then ‘match’ that information (in de-identified form) to cookies, mobile ad IDs, or other online identifiers. Because this “audience matched” information is derived from an email address or information that can be tied to an email address, it is possible to opt-out with an email address. However, when you opt-out in this way, you will need to submit all of the email addresses that you use for the opt-out to work.
 13.5.2 We also comply with the Self-Regulatory Principles for Online Behavioral Advertising as managed by the Digital Advertising Alliance (DAA). You may opt-out of receiving personalized ads from other companies that perform ad targeting services, including some that we may work with as Advertising Partners via the DAA website here.


14. EMAIL; COMMUNICATIONS

14.1 If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received online, mail, and telephone.
14.2 In compliance with the CAN-SPAM Act, all e-mails sent from our organization will clearly state who the email is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us. Our emails provide users the opportunity to opt-out of receiving communications from us and our partners by reading the unsubscribe instructions located at the bottom of any email they receive from us at any time. Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by clicking on the unsubscribe link in the email.
14.3 Without your consent or except if disclosed in this Privacy Policy, we do not record, monitor, edit, or disclose the contents of your communications with us, unless required to do so or in the good-faith belief that such action is necessary to: (a) comply with the law enforcement or with legal process served on us or the Website; (b) protect and defend our rights or property of, the Website, or the users of the Website; or (c) act in an emergency to protect the personal safety of our guests, the Website, or the public.


15. MARKETING COMMUNICATIONS; OPTING OUT

15.1 We only send mail, messages and other communications relating to marketing where we are authorized to do so by law. In most cases, we rely on your consent to do so (especially where we use electronic communications). If, at any time, you no longer wish to receive direct marketing communications from us, you can exercise this right by clicking the “unsubscribe” or “opt-out” link in the marketing emails we send you, or contacting us, or updating your preferences on your Account and/or on the Website.

You have the right to request deletion of your Personal Information that is no longer necessary for the purposes underlying the processing, processed based on withdrawn consent, or processed in non-compliance with applicable legal requirements. Please note that there are exceptions where we do not have to fulfill a request to delete information, such as when the deletion of information would create problems with the completion of a transaction or compliance with a legal obligation.
 16.1.4 Right to Restrict or Limit. You have the right to request us to restrict the processing of your Personal Information where the processing is inappropriate.
 16.1.5 Right to Object. You have the right to object to the processing of your Personal Information.
 16.1.6 Right to Data Portability. You have the right to request portability of your Personal Information that you have provided to us (which does not include information derived from the collected information), where the processing of such Personal Information is based on consent or a contract with you and is carried out by automated means.
16.2 Verification. In order to protect your Personal Information from unauthorized access or deletion, we may require you to verify your credentials before you can submit a rights request. If you do not have an Account with us, or if we suspect your account has been accessed without your authorization, we may ask you to provide additional Personal Information for verification.

Additionally, you may have the right to appeal the denial of any of these rights by submitting a form that will be provided to you if we deny a data request. We will not discriminate against any consumer for exercising their rights.


17. ADDITIONAL TERMS FOR CALIFORNIA RESIDENTS

17.1 This section applies only to California residents. It describes how we collect, use, and share Personal Information of California residents in our capacity as a “business” under the California Consumers Privacy Act as amended by the California Privacy Rights Act (“CCPA”) and your rights with respect to that Personal Information. For purposes of this section, the term “Personal Information” has the meaning given in the CCPA but does not include information exempted from the scope of the CCPA. Please note that we may claim legal exemptions for certain types of personal information and certain Intuit companies from all or certain parts of the CCPA.. This section describes our practices currently and during the 12 months preceding the effective date of this Privacy Policy.
17.2 Personal Information We Collect. We collect identifiers (such as email) non-identifiers (such as username and password), and Internet or other electronic network activity information (such as usage information, IP address, cookie information).
17.3 Why We Collect Your Personal Information. We use identifiers to provide the services requested, such as to;
 17.3.1 Register you as a new customer;
 17.3.2 Process and deliver your orders;
 17.3.3 Manage your relationship with us;
 17.3.4 Enable you to participate in promotions, competitions, and surveys;
 17.3.5 Improve our Website, products and services;
 17.3.6 Recommend/advertise products or services which may be of interest to you;
 17.3.7 Comply with our legal obligations, including verifying your identity where necessary;
 17.3.8 Detect fraud.
 17.3.9 We use identifiers and non-identifiers for general website administration, which includes record keeping, troubleshooting, data analysis, testing, and survey purposes.
 17.3.10 We use identifiers and Internet or other electronic network activity for trend monitoring, marketing, and advertising, as well as to ensure website security.
17.4 With Whom We Share and Sell Your Personal Information.
 17.4.1 We share Personal Information as necessary for certain “business purposes,” as defined by the CCPA (Cal. Civ. Code 1798.140(d)). This includes sharing identifiers and internet or other electronic network activity with providers of website analytics, email, product feedback and helpdesk services.
 17.4.2 While we do not sell Personal Information in exchange for any monetary consideration, we do share Personal Information for other benefits that could be deemed a “sale,” as defined by the CCPA (Cal. Civ. Code 1798.140(t)(1)). This includes sharing identifiers and internet or other electronic network activity with advertising networks, website analytics companies, and event sponsors.
17.5 Right to Opt-out of Sale. We comply with the CCPA and wish to provide you with control over how your Personal Information is collected and shared. You have the right to direct us to not sell your Personal Information and to exercise your right to opt-out by sending us an email via [email protected].
17.6 Right to Request Disclosure. You have the right to request disclosure about what categories of Personal Information we have sold or disclosed for a business purpose about you and the categories of third-parties to whom the Personal Information was sold or disclosed. Additionally, you have the right to request disclosure of specific pieces of information. Below is a full list of the information that you can include in your request.

17.7 Sensitive Personal Information. We do not collect sensitive personal information.
17.8 Authorized Agents. You may use an authorized agent to submit a rights request. If you do so, the authorized agent must present signed written authorization to act on your behalf, and you will also be required to independently verify your own identity directly with us and confirm with us that you provided the authorized agent permission to submit the rights request. This verification process is not necessary if your authorized agent provides documentation showing that the authorized agent has power of attorney to act on your behalf under Cal. Prob. Code §§ 4121 to 4130.


18. ADDITIONAL TERMS FOR EU and UK CITIZENS

18.1 Controller Information. Please note that for individuals located in the EEA or the UK, the term Personal Information used in this notice is equivalent to the term “personal data” under applicable European and UK data protection laws. We are the data controller of your Personal Information that we collect through the Website.
18.2 Data Transfer. In some cases, it may be necessary for us to transfer your Personal Information to countries outside of the United Kingdom, the European Union (EU)/European Economic Area (EEA) or any other non-EEA country not considered by the European Commission to offer an adequate level of protection. In such cases, apart from all appropriate safeguards that we implement, in any case, to protect your Personal Information, we have put in place additional adequate measures. We also continually monitor the circumstances surrounding such transfers in order to ensure that these maintain, in practice, a level of protection that is essentially equivalent to the one guaranteed by the General Data Protection Regulation (GDPR).


19. “DO NOT TRACK” DISCLOSURES

19.1 We honor “Do Not Track” settings in your browser concerning targeted advertising. We do not monitor or respond to Do Not Track browser requests.


20. THIRD PARTY SITES AND SERVICES

20.1 The Website may embed content provided by others or include links to other websites and applications. These companies may collect information about you when you interact with their content or services. Please be aware that we do not control and are not responsible for their information collection, use, and disclosure practices. Please review and understand their privacy practices and policies, if any, before providing any personal data to them or using any of their services. We are not responsible for the content or information of these third-party sites, any products or services that may be offered through them, or any other use of the sites.


21. CHILDREN’S PERSONAL INFORMATION

21.1 Our Website is intended solely for persons who, if they are a natural person, are eighteen (18) years of age or older, and any registration by, use of or access to our Website by any natural person under 18 is unauthorized, unlicensed and in violation of this Privacy Policy.
21.2 We do not collect Personal Information of children. If we learn that we have collected any Personal Information from a child, we will take reasonable steps to delete such information. Parents or guardians who believe that their child has submitted Personal Information to us and would like to have it deleted should contact us at [email protected].


22. NO PROFILING, AUTOMATED DECISION-MAKING

22.1 We do not engage in profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects. We do not process Personal Information to evaluate, analyze, or predict personal aspects related to your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements, to the extent this results in decisions that produce legal or similarly significant effects.


23. INQUIRIES AND COMPLAINTS

23.1 If you interact with the Website on behalf of or through your organization, then your Personal Information may also be subject to your organization’s privacy practices, and you should direct privacy inquiries to your organization.
23.2 If you have any privacy complaint, please contact us. Our privacy team will examine your request and respond to you as quickly as possible. In some particular cases (for example, if the matter is particularly complex or if you send us multiple requests), it may take us longer. In such cases, we will notify you accordingly and keep you updated.
23.3 If you are not satisfied with the outcome of a complaint, or if you are concerned about a potential violation, you also have the option to report the issue or make a complaint to the data protection authority in your jurisdiction.


24. REVISIONS
